The Mother of “Baby Poe” Chose to End Her Baby’s Life

BREAKING: On Monday Cincinnati Right to Life reported the Kentucky court case of a mother, “Mary Poe.” She was 8 weeks pregnant with her third child but was seeking an abortion in Kentucky. Supported by the attorneys of the ACLU, “Mary Poe” is suing the state of Kentucky, seeking to restore her right to an abortion.

Filed in state court in Louisville, the suit claims that Kentucky laws blocking abortions violate the plaintiff’s constitutional rights to privacy and self-determination. It asks that Kentucky’s life-saving laws be struck down by a judge in Jefferson County Circuit Court.

It was shared by several news sources that on Wednesday of this week, two days after the hearing in Jefferson County Court, “Mary Poe” aborted “Baby Poe” in a different state. In the original filings, “Mary Poe” shared, “I feel overwhelmed and frustrated…” as well as explaining that Kentucky’s life-saving laws, “place an enormous burden on me.” Planned Parenthood’s research arm, Guttmacher, reported in a peer-reviewed study, that the two most common reasons women state they abort are, “a baby would change my life” and “financial.” “Mary Poe” tragically fell into these categories for reasons to deny life for her unborn child.

Cincinnati Right to Life is extremely saddened by this news. We pray for “Mary Poe” and her family. Cincinnati Right to Life also shares the same sentiment as Kentucky Right to Life: Baby Poe’s life, though brief, represents the countless unborn children in Kentucky whose lives hang in the balance with the Mary Poe class action case filed by the ACLU.

As reported in the Kentucky Lantern: “Poe will remain a plaintiff in this case, court documents say, because she “satisfied Kentucky’s constitutional standing requirements at the time of filing, when she was pregnant and seeking abortion care.” Because of that, “this action continues to present a justiciable cause and should proceed,” the filing states. Poe is represented by the American Civil Liberties Union of Kentucky.”

Defendants in this suit include Russell Coleman, Kentucky’s Republican attorney general. “It’s the attorney general’s responsibility to defend the laws passed by the General Assembly, and we will zealously work to uphold these laws in court.”
