FDA’s Ruling Allows Video Call Exams and Mail Order Abortion Drugs

The abortion drug protocol which incorporates the drug mifepristone now accounts for more than 60% of the abortions taking place in this county. Not only does the administration of these drugs callously abandon a mother to suffer the process of abortion alone, the abortion drugs present significant health risks to the mother who takes these pills.

According to a comprehensive study conducted by the Ethics and Public Policy Center, the mother will experience “adverse events” which include hospitalization in more than 10.93% instances after taking the drug. 

Adding to the risk of taking the abortion drugs is a Biden era ruling by the Food and Drug Administration (FDA) which currently permits a health care worker to prescribe the abortion drugs by video call, never meeting the woman personally. The FDA ruling also allows a woman to arrange to receive the abortion drugs by mail order, often from unvetted sources.

Plaintiffs recently won a victory for women’s health and safety by demonstrating to the Federal Fifth Circuit Court of Appeals the dangerous and irresponsible lack of oversight by the FDA. On May 1, 2026 theFifth Circuit, blocked the FDA from allowing mail order abortion. The Fifth Circuit expressed skepticism for the FDA’s relaxation of safety guardrails including the removal of the “in person” exam requirement.

Regrettably, on May 14, 2026 the Supreme Court suspended the Fifth Circuits order. The FDA’s ruling allowing video call exams and mail order abortion drugs has been allowed to continue while the case is argued at the Fifth Circuit. Inevitably the case will return to the Supreme Court.

Dissenting in the decision to allow the FDA’s abortion drug ruling to continue, Supreme Court Justice Alito noted the impact when mail order abortion drugs are sent to states like Louisiana which ban abortion:

[w]hat is at stake is the perpetration of a scheme to undermine our decision in Dobbs v. Jackson Women’s Health Organization,” the court’s 2022 decision overturning the constitutional right to an abortion recognized in Roe v. Wade.

Continue to pray for the overturning of the heartless and cynical ruling by the Biden Administration’s FDA that allows video call medical exams and mail order abortion. Pray that women and their babies are protected. Pray also for the attorneys and judges as this works its way through the courts.
