Ohio Department of Health Order Upheld
July 10, 2014 (Cincinnati, OH): Hamilton County Court of Common Pleas Magistrate Michael Bachman has formally filed his decision on Lebanon Road Surgery Center vs. State of Ohio Department of Health, for which he heard oral arguments on Monday, June 30th.
As decided June 30th, Magistrate Bachman has upheld the ODH’s order that Martin Haskell’s Women’s Med Center (aka Lebanon Road Surgery Center) abortion facility in Sharonville, Ohio be denied a license and closed for operating outside the law.
During this court appeal, the Women’s Med Center abortion business has remained open under a stay of execution granted by Hamilton County Court of Common Pleas Judge Jerry Metz – the judge to whom the case was originally assigned.
Magistrate Bachman’s formally documented decision concludes: “6. The Stay granted in this matter granted on January 31, 2014 shall end at the close of business (4 p.m.) on the day this Magistrate’s Decision is docketed.”
Further action by Judge Jerry Metz remains to be seen.
