Magistrate’s Decision to be Filed Thursday
July 9, 2014 (Cincinnati, OH): As reported, Hamilton County Court of Common Pleas Magistrate Michael Bachman heard oral arguments for Lebanon Road Surgery Center vs. State of Ohio Department of Health on Monday, June 30th.
Magistrate Bachman upheld the ODH’s order that Martin Haskell’s Women’s Med Center (aka Lebanon Road Surger Center) abortion facility in Sharonville, Ohio be denied a license and closed for operating outside the law.
Magistrate Bachman is scheduled to formally file his decision by 4pm Thursday. He has stated that his decision lifts the stay and closes the abortion facility.
To finalize Magistrate Bachman’s decision, Hamilton County Court of Common Pleas Judge Jerry Metz – the judge to whom the case was originally assigned – must review and either accept, reject, or modify the Magistrate’s decision. There is no time limit for Judge Metz to make his final decision, and what he decides remains to be seen.

“With Magistrate Bachman’s decision, Judge Metz has further reason to immediately uphold the Ohio Department of Health’s order to close the Women’s Med Center Sharonville abortion business for operating outside lawful health and safety measures for patients.”
